1. Acceptance of terms
By downloading, installing, or using the AutoMen mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with these Terms, you must not access or use the App. By creating an account or accessing any user-generated content within the App, you confirm that you have read, understood, and accepted these Terms in their entirety.
2. Description of service
AutoMen is a social platform designed for automobile enthusiasts. The App provides features including but not limited to: user profiles and virtual garages, automobile clubs with posts, comments, and media sharing, direct and group messaging/chat functionality, a marketplace for vehicle-related listings and bidding, and content sharing across the platform.
3. User accounts
You must be at least 18 years of age to create an account and use the App. By creating an account, you represent and warrant that you meet this age requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. User-generated content
The App allows users to create and share content, including but not limited to text posts, images, videos, comments, messages, vehicle listings, and club posts ("User Content"). You retain ownership of the content you create but grant SPAZE SOCIOTECHNOLOGIES PRIVATE LIMITED a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content within the App for the purpose of operating and improving the service.
You are solely responsible for the User Content you post. You represent and warrant that you own or have the necessary rights to share any content you post, and that your content does not infringe on the intellectual property, privacy, or other rights of any third party.
5. Zero-tolerance policy for objectionable content
AutoMen maintains a strict zero-tolerance policy for objectionable content and abusive behavior. The following types of content and conduct are strictly prohibited on the App:
- Content that is offensive, abusive, threatening, harassing, defamatory, or hateful
- Content that promotes violence, discrimination, racism, or hatred against any individual or group
- Sexually explicit, obscene, or pornographic material
- Content that exploits or endangers minors in any way
- Spam, scams, phishing, or fraudulent content
- Content that promotes illegal activities, drugs, or controlled substances
- Impersonation of other individuals or entities
- Content that infringes upon copyrights, trademarks, or other intellectual property rights
- Sharing of personal or confidential information of others without their consent
- Any content that violates applicable local, state, national, or international laws
Violation of this policy will result in immediate removal of the offending content and may result in suspension or permanent termination of the offending user's account, at the sole discretion of AutoMen.
6. Content moderation and reporting
AutoMen employs content filtering mechanisms to detect and prevent objectionable material from being shared on the platform. Users are encouraged to actively report any content or behavior that violates these Terms.
Users may report objectionable content or abusive users through the in-app reporting feature. All reports will be reviewed by the AutoMen team within 24 hours. Upon verification, objectionable content will be promptly removed, and the offending user will be subject to disciplinary action, including account suspension or permanent ban.
AutoMen reserves the right to remove any content and suspend or terminate any user account at any time, with or without notice, for conduct that AutoMen determines, in its sole discretion, violates these Terms or is harmful to other users, the App, or third parties.
7. Blocking users
The App provides a mechanism for users to block other users who engage in abusive or objectionable behavior. When a user is blocked, the blocked user's content will be immediately removed from the blocking user's feed, and the block action will be reported to the AutoMen team for review. AutoMen will investigate all block reports and take appropriate action, including removing objectionable content and banning repeat offenders from the platform.
8. Messaging and chat
The App includes direct and group messaging functionality. All messages are subject to these Terms, including the zero-tolerance policy for objectionable content. Users must not use the messaging features to send unsolicited messages, spam, or any content that violates these Terms. AutoMen reserves the right to monitor messages for compliance with these Terms and to take action against users who violate this policy.
9. Intellectual property
The App, including its design, logos, trademarks, code, and all related intellectual property, is owned by SPAZE SOCIOTECHNOLOGIES PRIVATE LIMITED and its licensors. You may not copy, modify, distribute, sell, or lease any part of the App or its content without prior written consent from AutoMen. All rights not expressly granted herein are reserved.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
11. Disclaimers
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. AutoMen does not warrant that the App will be uninterrupted, error-free, or free of harmful components. AutoMen does not endorse any User Content and expressly disclaims any liability in connection with User Content. Use of the App is at your sole risk.
12. Limitation of liability
To the maximum extent permitted by applicable law, SPAZE SOCIOTECHNOLOGIES PRIVATE LIMITEDand its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the App. In no event shall AutoMen's total liability exceed the amount you paid, if any, for accessing the App.
13. Indemnification
You agree to indemnify, defend, and hold harmless SPAZE SOCIOTECHNOLOGIES PRIVATE LIMITED and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the App, your User Content, or your violation of these Terms.
14. Termination
AutoMen reserves the right to suspend or terminate your account and access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.
15. Changes to these terms
AutoMen may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms within the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
16. Governing law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
